This new legislation sets out a national policy for hydrogen, introducing fiscal incentives for companies investing in hydrogen technologies, simplifying regulatory processes for the installation of hydrogen facilities, and promoting partnerships between the public and private sectors. The Act focuses on infrastructure development for hydrogen production, storage, and distribution, including pilot projects in sectors like maritime transport. Notable provisions include the requirement for companies to obtain authorization from the Brazilian National Agency of Petroleum for hydrogen-related activities, the creation of the Rehidro program offering incentives for low-carbon hydrogen production, and inclusion in the Reidi program for infrastructure development incentives. The Hydrogen Development Program (PHBC) aims to support the energy transition by incentivizing the use of hydrogen in hard-to-decarbonize industrial sectors. Overall, this legal framework presents opportunities for investors to participate in Brazil's hydrogen sector, contributing to the country's environmental and economic goals.
