Australia Passes Legislation for Hydrogen and Critical Minerals Production Incentives
Key Ideas
  • Production tax credits for hydrogen and critical minerals processing almost finalized in parliament through a government-Greens deal.
  • Greens' amendments require subsidy beneficiaries to report on community benefit principles and consult for projects on First Nations land.
  • Legislation aims to support clean energy projects, create jobs, and foster decarbonization transition as part of a $22.7 billion manufacturing policy.
  • Hydrogen producers to receive $2 per kilogram tax incentive, while critical minerals producers will get 10% of processing costs.
The Australian parliament is on the verge of passing legislation that provides production tax credits for hydrogen production and critical minerals processing. After a deal between the government and the Greens, these incentives are set to become a reality. The Greens also pushed for amendments to ensure that subsidy beneficiaries adhere to community benefit principles and engage in mandatory consultations for projects on First Nations land. Despite some changes being voted down, the legislation is seen as crucial for supporting clean energy projects, creating jobs, and facilitating the decarbonization transition. The tax incentives are part of a $22.7 billion Future Made in Australia manufacturing policy. Hydrogen producers are set to receive a tax incentive of $2 per kilogram of renewable hydrogen produced, while critical minerals producers will benefit from 10% coverage of processing and refining costs. Industry leaders, such as Fortescue Metals chief executive Dino Otranto, have expressed support for the legislation, viewing it as a critical step in building a green iron metal industry. The Business Council of Australia welcomed the laws' passage but cautioned against making them overly restrictive. The legislation has also received praise from union leaders like ACTU president Michele O'Neil and Australian Workers' Union national secretary Paul Farrow, who believe it will create new jobs, particularly in regional areas, and enhance Australia's processing and manufacturing capabilities.
